Terms of Service

1. The Service

Sellmora generates suggested Etsy listing content — including titles, tags, and descriptions — based on the product details or photos you provide, using AI. The output is a suggestion to help you write your own listings.

We are not affiliated with, endorsed by, or connected to Etsy, Inc. "Etsy" is a trademark of Etsy, Inc. You are responsible for ensuring your use of any generated content complies with Etsy's own policies and terms.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the Service.

3. Accounts

• You are responsible for keeping your login details secure.
• You are responsible for all activity under your account.
• You agree to provide accurate information and not to create accounts to abuse free usage limits.

4. Free and paid plans

• The Service offers a free tier with a limited number of generations and a paid "Pro" subscription with expanded access.
• Pro is billed at €19 per month via Stripe, recurring until cancelled.
• Prices may change; we will give notice of changes before they affect your next billing cycle.
• You can cancel at any time via your account. Cancellation stops future billing; access continues until the end of the current paid period.

5. Refunds

If you are not satisfied, contact us at hello@sellmora.app within 14 days of your payment and we will provide a refund for that billing period. This is in addition to any statutory rights you may have as a consumer. Note that by starting to use a digital service immediately, EU consumers may waive the standard 14-day withdrawal right where applicable; regardless, our 14-day satisfaction refund above applies.

6. Acceptable use

You agree not to:

• Use the Service for unlawful purposes;
• Attempt to break, overload, reverse-engineer, or abuse the Service;
• Create multiple accounts to evade usage limits;
• Resell or redistribute the Service without our permission;
• Submit content that is illegal, infringing, or harmful.

We may suspend or terminate accounts that breach these Terms.

7. AI-generated content

• Generated content is provided "as is" and may contain inaccuracies. You are responsible for reviewing, editing, and verifying it before use.
• You are responsible for ensuring your listings are truthful and comply with Etsy's policies and applicable law.
• Similar suggestions may be generated for other users; we do not guarantee that output is unique.

8. Your content and ownership

• You retain ownership of the product details and photos you submit.
• Subject to your compliance with these Terms, you may use the generated listing content for your own Etsy shop and business.
• You grant us a limited licence to process your submitted content solely to operate and improve the Service.

9. Intellectual property

The Service itself — including its software, design, and branding — belongs to us. These Terms do not grant you any rights to it beyond using the Service as intended.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind. We do not guarantee that using the Service will increase your sales, search ranking, or visibility on Etsy. We do not guarantee uninterrupted or error-free operation.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential losses, or for lost profits, sales, or data, arising from your use of the Service. Our total liability to you for any claim is limited to the amount you paid us in the three months before the claim.

Nothing in these Terms limits liability that cannot be limited by law.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service.

13. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction, except where mandatory consumer protection law provides otherwise.
